Welcome to FPJ’s Weekly Legal Wrap, where we bring you the most important rulings and observations from the Bombay High Court.
This week’s top legal developments include:
🔹 Mumbai Flooding: The Bombay High Court observed that citizens cannot blame only the BMC for annual flooding, stating that encroachments, blocked drains and misuse of public infrastructure have contributed to the problem.
🔹 Insolvency Law: The High Court ruled that creditors do not need a court decree before filing claims against an insolvent person. The Official Assignee must independently assess the genuineness of the claim.
🔹 Motor Accident Compensation: The court enhanced compensation by over ₹37 lakh for the family of a Nashik girl who remained in a coma for nearly 16 years following a road accident, recognising the long-term burden of caregiving.
🔹 Death Penalty Commuted: The High Court converted the death sentence of two men convicted in a kidnapping-for-ransom murder case into life imprisonment, holding that the case did not fall within the “rarest of rare” category.
