A private citizen who got a jury summons in the mail and sat through five weeks of the most horrific testimony imaginable held his position for 38 hours of deliberation and refused to fold. And for that, millions of strangers decided he was defective. Kim argues this instinct — the urge to disqualify the human who reached the wrong conclusion — is a symptom of something much larger: we are losing our trust in human judgment itself, at the exact moment AI is being positioned to replace it. And this isn’t science fiction. COMPAS, the risk-assessment algorithm already used in courtrooms across nine states, has been shown to flag Black defendants as high risk at nearly twice the rate of white defendants who never reoffend. AI jury-selection tools — VenireIQ, StrikeList AI, Momus Analytics — are already being sold to trial lawyers. A University of North Carolina law professor ran a mock trial in 2025 where ChatGPT, Claude, and Grok sat as the literal jury. Estonia piloted an AI small-claims judge. China’s courts are using AI to draft verdict language in real cases right now. And Anthropic — the company behind Claude — ran “Project Panama,” physically acquiring and destroying millions of books to train its models, settling the resulting lawsuit for $1.5 billion. Kim traces the three-stage pattern: surveillance (we handed over our data voluntarily because it was convenient), control (algorithms quietly started deciding what we see, who gets loans, who gets flagged), and now judgment — the stage we’re entering. The pitch is always the same: efficiency, consistency, fairness. The problem is always the same: you don’t eliminate human bias by hiding it inside a machine. You just centralize it somewhere harder to see, harder to cross-examine, and impossible to look in the eye and ask to reconsider. Before we cheer the removal of the imperfect human from the jury box, Kim asks us to remember — the imperfect human wasn’t accidentally put there. The imperfect human was the point.
