President Trump’s justice department will investigate the pre-emptive pardons Joe Biden gave to his family during his final days in office.

A senior official told staff on Monday he had been directed to investigate the Democratic president’s use of autopen, a device used to automatically affix a signature to a document.

Ed Martin, the department’s pardon attorney, wrote in an email seen by Reuters that the investigation centred around whether Biden “was competent and whether others were taking advantage of him through use of autopen or other means”.

Trump has frequently raised his suspicions about the use of an automatic device for Biden’s signature after it was highlighted in research by the Heritage Foundation, a right-wing think tank, which in early March claimed almost every document during his presidency carried an identical signature.

This included some pardons that were issued in Washington in December 2022 to six convicts while Biden was on holiday in the US Virgin Islands.
