In Trump news, here’s why advocates say Betsy DeVos’ new Title IX plan could hurt survivors. Jess Davidson is the Interim Executive Director of End Rape on Campus, an organization that aims to end sexual violence on campus. After being sexually assaulted in college, Davidson decided to file a Title IX complaint.

Davidson: Had this regulation been enacted during the time when I went through with my case the university wouldn’t have allowed me to move forward. It wouldn’t have counted. … And so I decided to move forward with the complaint so that I could feel safe on campus. But like the majority of students I was sexually assaulted off campus. It was barely off campus by literally just a stone’s throw. But because of an arbitrary line and getting sexually assaulted on the wrong side of the street. Had this regulation been enacted during the time when I went through with my case the university wouldn’t have allowed me to move forward. It wouldn’t have counted.

Under DeVos’ proposed Title IX regulations, colleges would not be held liable unless the incident occurred on campus or involves a student organization.

Davidson: ‘That’s ridiculous because seeing my assaillant in the library it was causing me to have to leave the library to go throw up. It was extremely disruptive to my education. It didn’t matter where I had been sexually assaulted. What mattered was how it was imparting my ability to finish school and to graduate. ‘

Title IX is a civil rights law that bans sex-based discrimination at any educational institution that receives federal funding.

In November 2018, DeVos proposed new regulations that Davidson says would limit a school’s liability, narrow the definition of sexual harassment, allow mediation and cross-examination.

The proposed regulations wont go into effect until a 60-day comment period ends on Jan 30. The Department of Education is required to respond to all comments it believes are substantial and then make a decision.
